Judge Okays Road Near UD Wind Turbine on Lewes Campus

DOVER, Del. (AP) - A Delaware judge has rejected a Lewes resident's effort to halt construction of a road near a wind turbine at the University of Delaware's Lewes campus.

Gerald Lechliter filed a lawsuit last year challenging erection of the wind turbine on what he say was supposed to be open space land.

Lechliter argued this week that a road being built in the area lies within a "fall zone" surrounding the turbine, posing a potential safety risk if the 410-foot-high tower should topple.

Hints That Judge Will Rule for UD in Wind Turbine Case

GEORGETOWN, Del. (AP) - A Delaware judge is hinting that he is not likely to issue a restraining order halting construction of a road near a controversial wind turbine adjacent to the University of Delaware's Lewes campus.

Lewes resident Gerald Lechliter sought the restraining order, arguing in Chancery Court that part of road would be within a "fall zone" safety area surrounding the wind turbine.

But attorneys for state environmental department and the university argued Monday that Lechliter had not shown any harm that might result from construction of the road.
